The amexconnect.com.au online service has two main components:
• the amexconnect.com.au website; and the email communications and offers we send as part of amexconnect.com.au

The Terms of Service apply only to this Service. It does not affect in any way the card agreement governing your American Express card.
After you register for the site you can access offers, services, promotions and deals (all "Offers") from our partners. Offers are posted on the website and sent to you by email, depending on your preferences. The Offers themselves come from various partners of ours, but generally they will come from American Express merchants and other partners who have agreed to make their deals and offers available to Cardmembers, this might include online merchants and wholesalers who we have an agreement with (all "Partners").
By registering, you agree to receive weekly and monthly communications by email that will include Offers from these Partners. We may also send you ad-hoc Offers from time to time depending on your Offer preferences. You can unsubscribe from these emails at any time by changing your communication preferences.
You can choose which categories of Offer you are interested in and customize the types of email offers you want to receive. For example, you can choose to receive Offers relating to Accommodation & travel, Entertainment, lifestyle & sport or Fashion & shopping. Or, you can choose to receive no Offers at all.
IMPORTANT: Whilst American Express gives you access to the Offers through the Service, American Express does not accept any liability or responsibility for the Offers in any way, nor is American Express liable to honor, fulfil or complete any Offer. By accepting an Offer, you are contracting with the relevant Partner, not American Express. You should read the information about each Offer, including the terms and conditions, carefully.
All Offers are priced in Australian Dollars (unless otherwise stated) and are intended to be valid for residents in Australia only.
Partner Offer Terms & Conditions

All Partner Offers are subject to the Partner’s Offer terms and conditions which you will need to agree to in order to take up an Offer. The following terms apply to all Offers:

Yes. American Express has the right to change these Terms of Service at any time for security, regulatory or legal reasons or for other reasons, such as improvements or changes to the Service or to make the Terms of Service clearer. If we do change these Terms of Service, we will post the latest version on the amexconnect.com.au homepage and other sites we use for the Services. We will also change the Last Modified date at the top of these Terms of Service.
Changes will take effect as at the date the changes were posted. If you do not agree with any changes, you should not use the Service. If you use the Service after we post the notice of the changes, you are agreeing to those changes.
We have the right to change or stop all or any part of the Service at any time. We won’t give you notice unless we are required by law to do so.
We are not liable or obligated to you or your business if we stop or change any Services at any time.
We will seek all remedies available for violations of these Terms of Service. For example, we have the right to suspend access to the Service from a particular Internet address.
We will take any appropriate legal action for any illegal or unauthorized use of the Service any violation of these Terms of Service.
American Express may report any unlawful activity to the relevant authorities and will co-operate with those authorities including, if appropriate, by disclosing your identity to them.
Trademarks, tradenames, logos, and service marks, domain names or other distinctive brand features appearing on the Service are the property of American Express, its trademark licensors, and other parties. (We call these items marks.) You cannot use any of our marks or intellectual property rights. You cannot use our metatags or any other type of hidden text without written permission from us or from the third party which may own the marks.
Intellectual property laws protect information and content available on or through the Service. Those laws cover any software programs, documents, graphics, information, content or other materials, other than your posts. (We call those items Service Content).
With respect to any Service Content, except as permitted below, you are prohibited from doing any of the following:
• reverse engineering,
• creating derivative works from or based on, or
• otherwise using in any manner or for any commercial or public purposes.
If you comply with these Terms of Service and intellectual property laws when you access and use the Service, we grant you certain limited rights to access and use Service features, information, materials, functions and Service Content available on the Service, and to participate in the Service, and download content, as available, for non-commercial purposes. We can revoke these rights, and they are not exclusive. You cannot transfer or sublicence them.

We do not control third-party sites, tools or linked sites

Nothing in these Terms of Service or otherwise will exclude or limit American Express' liability (i) arising as a result of American Express’ fraud or fraudulent misrepresentation, (ii) for death or personal injury caused by American Express, or (iii) that otherwise may not be excluded under applicable law.
American Express is not liable or responsible for any information, content, software, goods or services offered or provided by or on behalf of any third-party creator, carrier or other supplier or distributor through a website, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligent or otherwise, of such third party.
You release American Express from any liability with respect to third party services.
Only registered or subscribed users are allowed to use the Service. To use the Service, you need to create a password and provide your email address. (We call these credentials.)
Your email address does not need to be your personal email address or include your real name and in fact, we would encourage you to not to use any information that might identify you. Do not share of disclose your credentials. You must always safeguard them.
• Log out at the end of each session.
• Do not allow anyone to use your credentials to gain access to the Service or your account.
• Promptly notify us of any unauthorized use of your credentials.
• Update your contact details if they change.
If we suspect fraudulent or abusive activity, we can interrupt or restrict your use or access to the Service without notifying you
You must cooperate with us in any fraud investigation. You must also use any fraud prevention measures we set.
Create an Honest Personal Profile
When using the Service, you may also be asked to create a profile and set preferences. In such cases, you will provide certain contact information. (We call that your Profile). If you create a Profile, you must give us true, accurate, and current information.
In your Profile:
• Do not use anyone else’s email address, username, password, or other account information.
If we suspect that any information you provided is not authorized, correct, current, or complete, we may refuse you access to the Service (including any Registration Required Service) or any of its resources. We may suspend or end your access without notifying you.
Parts of the Service are designed for use with various communications means and methods (e.g., phonelines, modems, Wi-Fi, email, SMS), and on desktop, wireless and mobile devices.
If you use the Service, you may electronically transmit your information across the networks of wired and wireless service providers. You are responsible for such devices and access, including without limitation, for obtaining and maintaining all wired or wireless telecommunications, broadband, and computer hardware, equipment, and services needed to access and use the Service, and payment of all fees and related charges.
We do not operate these communication networks. We do not control the operations of the communication networks service providers. We cannot guarantee that your data transmissions are private or secure.
We are not liable if anything interrupts, prevents, or affects any of your transmissions, communications, posts, or transactions or other activities on or through the Service, or if anything interference with the integrity of any transmission.
For example, we are not responsible for:
• unavailable wired or wireless service,
• failed, interrupted or misdirected communications,
• network delays,
• coverage limitations,
• system outages, or
• connection interruptions.
We are not responsible for any wired, wireless, or mobile service you use to access or use the Service.
We do not charge you to use or access the Service when you agree to these Terms of Service. However, your Internet, wired, wireless, mobile service providers may charge you for services. They may charge you to transmit or receive messages or to otherwise communicate. (For example, they may charge you to post, review Service Content, etc.) You are responsible for those charges.
If you communicate or interact with Partners, like advertisers or merchants that you find through the Service (including but not limited to corresponding with them or participating in their offers, promotions, or shopping for or purchasing their products or services), your dealings are between you and them, and we are not responsible. Any terms, conditions, representations, or warranties for or associated with advertisers’ products, services, dealings, or correspondence are between you and them. We make no representations or warranties for advertising content. We are not liable for any products or services advertised or that you may obtain from or through those third-parties.
You agree that we are not responsible or liable for any loss or damage you may incur as a result of:
• any dealings or correspondence between you and the advertisers; or
• content, information, software, products, or services of the advertisers
We will try and handle all claims and disputes that arise out of or are related to these Terms of Service as efficiently and fairly as possible. We therefore recommend submitting such claims and disputes first to non-binding mediation.
If the disputes are not resolved through mediation, then we would suggest submitting the claim or dispute for binding arbitration.
Jurisdiction and Governing Law
These Terms of Service are governed by and, construed in accordance with the laws of Australia
The state of New South Wales and the courts of Sydney shall have non-exclusive jurisdiction over any claim arising from, or related to these Terms of Service or the Service itself.
No investment advice or offers
Nothing in the Service is investment advice, including American Express’ filings with the United States Securities and Exchange Commission.

amexconnect.com.au enables you to receive and access great deals and offers from our partners. This Privacy Statement describes how American Express collects information as part of the amexconnect.com.au service. In particular, when you:
visit our sites or use our mobile applications;
open and respond to any of our e-mails; or
visit any third party sites or use their mobile applications that display our ads or content.
This Privacy Statement applies only to our Australian customers and to users of our online sites, services, tools and applications in Australia.

• with Vendors (who are required to safeguard Personal Information) that help us operate the service;

We may share Non-Personal Information:

American Express (We, Our, Us) – American Express Limited.
American Express Family of Companies – American Express Limited, American Express Company, American Express Centurion Bank, American Express Bank, FSB, American Express Travel Related Services, American Express Publishing, and any other company owned and/or controlled by American Express Company.
Business Partners - any third parties with which we conduct business and have a contractual relationship such as businesses that accept American Express (i.e. American Express Merchants) or partners who offer deals as part of the amexconnect.com.au service. Business Partners are not Vendors.
Clickstream Data - usage and browsing information, such as a user’s page viewing history and clicks on items within a website, usually stored in log files.
Cookie - a small data file placed on your hard drive. Cookies help us keep records, store your preferences, and improve our advertising.
IP Address - a number assigned to a device when connecting to the Internet.
Non-Personal Information - information that cannot identify a person such as Cookie data. It may be derived from Personal Information, so long as all Personal Information has been removed.
Other Sources - American Express internal information (transaction data, for example), external data used by Business Partners or financial companies to process applications and complete transactions, and other online and offline information legally obtained and outside the scope of this Statement at the time of collection.
Other Web & Mobile Technologies - web beacons, pixels, and other technologies, which transfer information from your computer or mobile device to a server connected to the Internet.
Personal Information - information that can identify a person, such as name, address, telephone number, and e-mail address.
Third-Party Ad-Servers - companies that provide the technology to place ads on websites and track ad performance.
Vendor - any third party that performs business operations on behalf of American Express, such as printing, mailing, and other communications services (e-mail, direct mail, etc), marketing, data processing, servicing, collections, or ad management. Vendors are not Business Partners.
